Terms and Conditions of Use

These Terms and Conditions govern access to, browsing, and use of the Firma Vivienda platform, owned by Firma Vivienda S.L. (hereinafter, "the Platform"), available at firmavivienda.com.

1. Purpose of the service

Firma Vivienda offers a digital system for the automated generation of earnest money contracts, document management, file validation, and assistance in processes related to real estate transactions. The Platform is a technological tool that allows users to create, store, and manage documents securely, but does not intervene in the financial or legal negotiation between buyer and seller.

Firma Vivienda does not act as a real estate agent, intermediary, mediator, lawyer, notary, or fund custodian. Its role is exclusively technical and documentary.

2. Acceptance of conditions

Access to or use of the Platform implies full and unreserved acceptance of these conditions. If the user does not agree with any of their terms, they must refrain from using the service.

3. User registration

To use certain features, registration via email and password is required. The user agrees to:

  • Provide truthful, accurate, and up-to-date information.
  • Maintain the confidentiality of their credentials.
  • Not transfer their account to third parties.

4. Service functionality

The user acknowledges that the Platform:

  • Generates documents based on the information entered by the parties.
  • Does not guarantee the truthfulness, completeness, or accuracy of the data provided by users.
  • Does not replace legal, technical, or professional advice.
  • Does not review contractual content beyond basic consistency checks.

5. User obligations

  • Enter only truthful and verified information, especially regarding personal identity, registry data, and property documentation.
  • Not use the Platform for unlawful or fraudulent activities.
  • Not impersonate third parties.
  • Not manipulate or alter the functioning of the services.

6. Payments and billing

Certain services require the payment of fees for the generation and management of the earnest money contract, equivalent to:

€499 VAT included per transaction.

Payment is processed through a secure payment gateway that complies with the PCI DSS standard. The user authorises Firma Vivienda to issue an electronic invoice for the services provided.

7. Nature of Firma Vivienda's role

The user expressly accepts that Firma Vivienda:

  • Does not participate in the earnest money payment or in the transfer between buyer and seller.
  • Does not guarantee the legal or physical availability of the property.
  • Does not verify the authenticity of the documentation provided.
  • Does not assume responsibility for discrepancies between the parties or for breaches.

8. Limitation of liability

Firma Vivienda shall not be liable for:

  • Errors, omissions, or falsehoods in the information provided by users.
  • Disputes arising from the sale, earnest money, or conditions agreed between the parties.
  • Loss of profits, indirect damages, or losses arising from the use of the service.
  • Service failure due to technical causes, maintenance, or external providers.

9. Intellectual property

All texts, designs, code, tools, and templates are the property of Firma Vivienda S.L. Their copying, distribution, or use outside the Platform without prior authorisation is prohibited.

10. Suspension and cancellation

Firma Vivienda may suspend or cancel accounts that breach these conditions or use the Platform in a fraudulent or illegal manner.

11. Amendments

Firma Vivienda may update these conditions when necessary due to legal, technical, or service changes. Updated versions will be accessible on the website.

12. Applicable law

These conditions are governed by Spanish law. In case of dispute, the parties submit to the Courts and Tribunals of Valencia, unless mandatory regulations provide for a different jurisdiction.
